Child Support in California

Child support is determined (in California) by the use of a computer program that analyzes specific information and is available to all judges and the family law attorneys. The computer-based determination makes results more consistent throughout the state than it has been in the past, taking into consideration the income of both parents, and the percentage of time each parent has physical custody of the children, as well as other factors. Spousal Support in California

Spousal support, also known as alimony or spousal maintenance, is sometimes calculated using the same computer program used to calculate child support. However, the judge has more discretion in determining the amount and duration of spousal support and may consider the standard of living during the marriage, the income of both parties and the duration of the marriage.

Spousal support will terminate upon death or remarriage of the receiving party. Spousal support may also have a specified duration. One general rule of thumb is that spousal support will continue for approximately one half the term of the marriage, although this may vary by individual circumstances. The exception is if the parties have had a long term marriage (greater than 10 years), then spousal support could continue indefinitely until the spouse receiving the support remarries or dies.
